NetApp Forces Coraid ZFS Product Off the Market

Brown, who notes that ZFS is now open source, says Oracle and NetApp are trying to settle the claim-counterclaim out-of-court

Coraid, the Ethernet SAN start-up, has gotten caught in the legal crossfire between NetApp and Sun Microsystems and has pulled its new EtherDrive Z-Series NAS appliances bundled with Nexenta's ZFS distribution off the market at NetApp's insistence.

NetApp, remember, is suing Sun claiming that the Sun-created ZFS file system infringes a dozen of its patents.

NetApp claims that since Coraid's Z-Series is based in ZFS and claims to be a unified storage solution it perforce infringes its patents too.

A letter from NetApp's lawyers Weil, Gotshal displayed on Coraid's web site under a note to customers from Coraid CEO Kevin Brown threatens legal action.

Brown, who notes that ZFS is now open source, says Oracle and NetApp are trying to settle the claim-counterclaim out-of-court and that Coraid is going to wait out the talks but that "NetApp's expansion of legal threats to the open source community marks a significant escalation in their effort to block adoption of the ZFS file system, which has been downloaded more than one million times by end customers and vendors."
